La Seconde Guerre mondiale s’achève en septembre 1945 mais la victoire militaire ne suffit pas et une question se pose aux vainqueurs : comment juger les crimes qui y ont été commis à une échelle sans précédent, alors même que le droit international n’a jamais prévu de tels actes ? Ainsi va naître une justice inédite avec la création du tribunal militaire international de Nuremberg. Mais peut-on juger sans renoncer à l’État de droit ? Peut-on créer un nouveau crime, le crime contre l’humanité, sans violer le principe de non rétroactivité des lois pénales ?
